1. Agreement to Terms

These Terms of Service apply to your use of www.arctecai.com, our contact and booking flows, and any creative, marketing, strategy, production, portal, or related services we provide under a separate agreement. By using the site or services, you agree to these Terms. If you do not agree, do not use the site or services.

2. Site and Services Overview

Arctec AI offers subscription and project-based services, including:

  • Social media management and content retainers
  • Video production and campaign shoots
  • Google SEO and web development
  • Design, photography, creative direction, and AI-related consulting
  • Access to client coordination tools or portal features where separately provided

Marketing copy on the site is informational. If there is any conflict between the site and a signed proposal, statement of work, invoice, client agreement, or other written contract, the signed document controls.

3. Acceptable Use

  • You must provide accurate and current information when contacting us or booking meetings.
  • You must not use the site or services for unlawful, abusive, fraudulent, defamatory, or unauthorized purposes.
  • You must not scrape the site, run automated abuse against forms or APIs, probe for vulnerabilities, interfere with availability, or attempt unauthorized access to any private feed, account, or portal environment.
  • You must not upload or transmit malicious code or any information you are not legally permitted to share.

4. Inquiries, Bookings, and Eligibility

  • Submitting a contact form or booking a call does not guarantee that we will accept you as a client or offer a specific service package.
  • We may decline inquiries, cancel bookings, or refuse service where appropriate.
  • You are responsible for ensuring that any information you submit is truthful and does not violate another person's rights.

5. Pricing, Billing, and Cancellations

Our site currently lists four core pricing options: Custom Package (custom pricing), Basic Package ($1,800/month), Growth Package ($3,200/month), and Supreme Package ($5,400/month). All amounts are in CAD unless stated otherwise. Pricing and package scope may change, and any final quote or signed agreement will control over the website summary.

  • Subscriptions are generally billed monthly in advance unless we agree otherwise in writing.
  • Payment is due as stated on the applicable invoice or agreement.
  • Late payment may result in paused work, withheld deliverables, suspended private integrations, or suspended portal access where applicable.
  • Unless otherwise agreed in writing, fees already paid are non-refundable.
  • You may cancel recurring services with 30 days written notice unless a signed agreement states a different minimum term.

6. Client Responsibilities

To help us deliver services effectively, you agree to:

  • Provide timely access to brand assets, account access, guidelines, approvals, and feedback.
  • Ensure materials you provide do not infringe third-party rights or violate applicable law.
  • Maintain current billing and contact information.
  • Use secure channels for especially sensitive information when we request them.

7. Portal and Private Integrations

  • Any portal, dashboard, or private feed access is intended only for authorized users and approved business purposes.
  • You are responsible for keeping credentials, API keys, and account access confidential.
  • You must not share private integration credentials publicly or use them in a way that exposes them in URLs, client-side code, or public files.
  • We may suspend or revoke access if we reasonably believe the site, portal, or a private integration is being misused.

8. Third-Party Services and Platforms

Our site and services rely in part on third-party tools and platforms, including Calendly, Google services, hosting and infrastructure providers, media-delivery vendors, portal software, and social or advertising platforms. Their availability, policies, and performance are outside our direct control.

  • Platform outages, API changes, account restrictions, scheduling failures, or vendor policy changes may affect service delivery.
  • You remain responsible for complying with the terms and policies of the accounts and platforms you ask us to manage on your behalf.

9. Intellectual Property and Portfolio Content

Upon full payment, you own the final deliverables created specifically for your project unless a written agreement says otherwise. Arctec retains ownership of its internal methods, templates, tooling, working files, raw footage, source files, and proprietary systems unless expressly transferred in writing.

  • We may showcase completed work in our portfolio, site, or marketing unless you request confidentiality in writing or a contract says otherwise.
  • Third-party logos, trademarks, platform names, and brand assets displayed on the site remain the property of their respective owners and are shown for identification or portfolio purposes only.
  • Third-party assets such as licensed music, fonts, footage, or software remain subject to their own license terms.

10. Confidentiality and Sensitive Information

Each party agrees to protect confidential business information shared during the relationship, including strategies, unreleased content, credentials, pricing, and business records, except where disclosure is required by law or necessary to provide the services.

Do not send payment card numbers, account passwords, government IDs, or other highly sensitive information through the public website unless we specifically request it through a secure channel.

11. Disclaimers and Limitation of Liability

Our site and services are provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee specific business results, search rankings, lead volume, follower growth, engagement, revenue, or platform performance.

To the maximum extent permitted by law, Arctec's total liability arising out of or related to our services will not exceed the amount you paid us in the three months immediately preceding the claim.

12. Termination

Either party may terminate an engagement according to the applicable written agreement or, if none exists, with 30 days written notice for recurring services. We may suspend or terminate access immediately if:

  • Payment is overdue.
  • You materially breach these Terms or any written agreement.
  • You misuse the site, a private integration, or our services, or request unlawful, harmful, or defamatory work.

13. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be brought before the courts located in Ontario, Canada, unless applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version here and revise the date on this page.
